Night time blitz shuts down pubs and clubs

PUBS and nightclubs found selling alcohol without legal documentation, or contravening the Nuisances and Behaviour in Public Places by-law are the target of multi-disciplinary enforcement operation between the city and SAPS.

The warning comes after a recent multidisciplinary night blitz in which eThekwini Municipality, with the assistance of the South African Police Service, prosecuted and closed down pubs and nightclubs that were found selling alcohol without legal documentation. Metro Police Deputy Head of Operations, Steve Middleton, said the operation was held in the Wentworth area and was part of the City’s daily by-law enforcements. The enforcement operation, which Middleton described as a success, led to the closure of three clubs and the prosecution of one. Middleton said the sale of alcohol without a license is a punishable offence by law.

The team visited popular night spots on Austerville Drive, Silvertree Road, Bluff Road and Chamberland Road. Middleton said the team was targeting notorious night spots. “Our team was not only looking for alcohol permits, but also checked to see if the business is registered and if there are any other illegal activities that were taking place in these establishments,” he said.
Middleton said they would also be visiting clubs that residents had reported for transgressing the nuisances and Behaviour in Public Places by-law.
“This by-law clearly states that no person may permit noise or sound from a private residence or business premises in his or her control to be audible to users outside of such premises to such an extent that it reasonably interferes with the use and enjoyment by an owner or occupier of his or her property,” he said, adding that the bylaw also makes it clear that no person may disturb fellow residents from Sunday to Thursday, between 21h30 to 07h00, and from Friday to Saturday, between 00h00 to 08h00.
He said enforcement operations would continue in other parts of the City and there were strict penalties in place for those found in contravention of any municipal by-law.
